TERMS & CONDITIONS - THE BASICS
TERMS AND CONDITIONS OF CONTRACT FOR WEDDING PHOTOGRAPHY SERVICES
In the following terms and conditions "the photographer" shall mean Mike Hardie trading as Mike Hardie Photography. "The client(s)" shall be those persons defined as bride and groom in the wedding booking. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
1. RETAINER FEE AND PAYMENT
A non-refundable retainer fee of £200 secures the photographer's time and services for the wedding date. This retainer is non-refundable in the event of cancellation and will be deducted from the total package cost when calculating the final balance due.
Payment Schedule:

Full payment of the remaining balance is due 4 weeks before the wedding day

For bookings made within 4 weeks of the wedding date, full payment is required immediately upon booking
2. WEDDING ARRANGEMENTS
All wedding details must be agreed in writing (email is acceptable). The client must notify the photographer of any changes to arrangements in writing. The photographer cannot be held liable for delays or disruption in service delivery until changes are received and acknowledged in writing.
3. CANCELLATION POLICY
The client may cancel this contract at any time by giving written notice to the photographer but shall forfeit the retainer fee paid.
Cancellation within 8 weeks of the wedding date will result in the client forfeiting:

The £200 retainer fee, plus

40% of the total package price
All cancellations must be confirmed in writing.
4. POSTPONEMENTS
Postponements made 2+ months before the wedding date: No additional charge Postponements made within 1 month of the wedding date: £50 administrative fee Postponements to a different year: Client will pay photographer's current package prices at time of new booking
5. TRAVEL
Photography services include free travel within a 30-mile radius of Perth, Scotland. Travel beyond this radius will incur charges of £1.40 per mile. Services are provided within the UK only, contact if outside UK.
6. MARKETING AND DISPLAY RIGHTS
The client hereby grants the photographer permission to display any photographs from this contract for business promotion including advertising, brochures, magazine articles, websites, social media, and sample albums. This right is granted unless specifically declined by the client in writing at the time of booking.
7. PHOTOGRAPHY COVERAGE AND LIMITATIONS
Service Delivery:

Photography coverage and number of edited images delivered are as detailed in the agreed package specification

All edited photographs will be delivered via online gallery within 1 month of the wedding date

Images will be adjusted for exposure, brightness, contrast, and sharpness at the photographer's discretion
Venue and Technical Limitations:

Color reproduction may vary due to lighting conditions and material properties, especially synthetic fabrics

Church ceremonies and certain venues may restrict photographer movement and positioning

The photographer cannot accept responsibility for obstructed views resulting from venue restrictions

Weather conditions may affect outdoor photography opportunities
8. PRINTING RIGHTS
Clients may purchase printing rights for an additional £200, which grants permission to reproduce photographs for personal use. Without purchasing printing rights, clients may not reproduce, copy, or print photographs.
9. COPYRIGHT
Copyright of all images remains with the photographer under the Copyright, Designs and Patents Act 1988. Clients receive a license for personal use including downloading, sharing on social media, and distributing to family and friends. Images may not be sold, licensed to third parties, submitted to competitions, or used for commercial purposes without written permission from the photographer.
10. EQUIPMENT AND BACKUP COVERAGE
The photographer carries backup equipment including multiple camera systems. In the unlikely event of equipment failure during the wedding, photography will continue with available backup equipment. The photographer cannot be held responsible for any reduction in image quality or coverage that may result from equipment failure. In the event of complete service failure due to catastrophic equipment loss, the client will receive a full refund of the package fee paid.
11. PHOTOGRAPHER AVAILABILITY
If the assigned photographer is unable to attend due to unforeseen circumstances, a qualified replacement photographer will be provided to fulfill the contract obligations.
12. LIMITATION OF LIABILITY
In the event of total photographic failure, cancellation, or any other circumstance, the photographer's liability is limited to the total value of the package paid. Neither party shall be liable for indirect or consequential losses including but not limited to rebooking costs, travel expenses, or emotional distress.
13. PERSONAL SAFETY
Any directions given to clients or guests during photography are followed at their own risk. The photographer is not responsible for personal accidents or injuries that occur during the wedding event, including but not limited to tripping over equipment, falling objects, or any other incidents whether or not related to photography activities.
14. ARTISTIC LICENSE
The photographer retains creative control over poses, locations, and artistic decisions. Due to weather conditions, venue restrictions, and subject cooperation, not all requested shots may be achievable.
15. GOVERNING LAW
This agreement shall be governed in accordance with the laws of Scotland.
