TERMS & CONDITIONS - THE BASICS

TERMS AND CONDITIONS OF CONTRACT FOR DOG PORTRAIT PHOTOGRAPHY SERVICES
In the following terms and conditions "the photographer" shall mean Mike Hardie trading as Mike Hardie Photography. "The client" shall be the person booking the dog portrait photography session. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
 
1. RETAINER FEE AND PAYMENT
A non-refundable retainer fee of £30 secures the photographer's time and services for the photography session. This retainer will be deducted from the total package cost when calculating the final balance due.
Payment Schedule:

  • Full payment of the remaining balance is due at least 48 hours before the scheduled shoot
     

2. SESSION ARRANGEMENTS
The client must notify the photographer of any changes to arrangements in writing.
 
3. CANCELLATION AND RESCHEDULING POLICY
Cancellation: The client may cancel this contract at any time by giving written notice to the photographer but shall forfeit the retainer fee paid.
Rescheduling: Sessions may be rescheduled free of charge with reasonable notice.
Weather Rescheduling: Outdoor sessions affected by severe weather conditions may be rescheduled at no additional charge.
No-Shows: Clients who fail to attend their scheduled session without prior notice may arrange a new session for an additional £20 administrative fee.
 
4. TRAVEL
Photography services include free travel within a 30-mile radius of Perth, Scotland. Travel beyond this radius will incur charges of £1.40 per mile. Services are provided within the UK only.
 
5. MARKETING AND DISPLAY RIGHTS
The client hereby grants the photographer permission to display any photographs from this contract for business promotion including advertising, brochures, magazine articles, websites, social media, sample albums, etc.
 
6. PHOTOGRAPHY COVERAGE AND DELIVERY
Service Delivery:

  • Number of edited images delivered are as detailed in the agreed package specification

  • All edited photographs will be delivered via online gallery within 1 week of the photography session

  • Images will be adjusted for exposure, brightness, contrast, sharpness, etc. at the photographer's discretion

  • Sessions may be conducted indoors or outdoors as agreed by the photographer and client
     

7. PRINTING RIGHTS
All images are provided for personal digital use. High-resolution images suitable for professional printing are available for purchase at £30 per image.
 
8. COPYRIGHT
Copyright of all images remains with the photographer under the Copyright, Designs and Patents Act 1988. Clients receive a license for personal use including downloading, sharing on social media, and distributing to family and friends. Images may not be sold, licensed to third parties, submitted to competitions, or used for commercial purposes without written permission from the photographer.
 
9. DOG BEHAVIOR AND COOPERATION
Aggressive Behavior: If a dog displays aggressive behavior that prevents safe photography, the session will be terminated and the client will receive a full refund including the retainer fee.
Uncooperative Behavior: If a dog's behavior significantly limits the number of usable photographs, refunds will be calculated based on the number of usable images delivered compared to the package specification, at the photographer's discretion.
 
10. LIMITATION OF LIABILITY
In the event of total photographic failure, equipment failure, cancellation, or any other circumstance, the photographer's liability is limited to a full refund of the package fee paid. Neither party shall be liable for indirect or consequential losses including but not limited to travel expenses or emotional distress.
 
11. PERSONAL SAFETY AND PROPERTY DAMAGE
Any directions given to clients during photography are followed at their own risk. The photographer is not responsible for personal injuries that occur during the photography session, including but not limited to dog bites, trips, falls, or any other incidents whether or not related to photography activities.
The photographer is not responsible for any damage to property (including the client's property, public property, or the photographer's own equipment) caused by dogs or human error during the photography session.
 
12. ARTISTIC LICENSE
The photographer's creative decisions regarding composition, lighting, timing, and artistic direction are fundamental to delivering work consistent with their established style and professional expertise. Clients engage the photographer specifically for their creative vision and technical judgment. While client preferences will be noted, final artistic decisions remain with the photographer to ensure stylistic coherence and professional quality standards. Due to weather conditions, location restrictions, and animal behavior, not all requested shots may be achievable.
 
13. GOVERNING LAW
This agreement shall be governed in accordance with the laws of Scotland.

By booking Mike Hardie Photography services, the client acknowledges they have read, understood, and agree to be bound by these terms and conditions.
